PART A: GENERAL TERMS AND CONDITIONS – KNOWLEDGESPARK.IN LMS

This is a computer-generated electronic record under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and the Information Technology Act, 2000.

These Terms and Conditions (“Terms”) are a legal agreement between you (“User” or “You”) and VLSIPRO TECHNOLOGIES (OPC) PRIVATE LIMITED, operating under the brand “Knowledgespark.in” (“Knowledgespark”, “we”, “us”, “our”). These Terms govern your access to and use of the Knowledgespark.in learning management system (“LMS”) including courses, training materials, assessments, applications, technology, tools, and all related services provided via www.knowledgespark.in and its mobile applications (“Platform”).

By accessing the Platform or using the services, You agree to be bound by these Terms and our Privacy Policy. If You do not agree, please discontinue use of the Platform.

  1. PROPRIETARY RIGHTS
    We own all rights, title, and interest in the Platform, content, trademarks, logos, and intellectual property therein. You are granted a personal, non-exclusive, non-transferable, limited license to access the Platform for educational use only. You may not modify, reverse engineer, copy, or distribute any part of the Platform or content without prior written consent.

  2. USER ELIGIBILITY AND RESPONSIBILITIES

  • You may register on the Platform only if you are 18 years or older and legally capable.

  • You must provide accurate information during registration and maintain confidentiality of your account credentials.

  • You are responsible for all activities under your account.

  • You agree not to use the Platform for unlawful purposes, or to upload or distribute harmful, defamatory, obscene, or unauthorized content.

  • Knowledgespark may suspend or terminate your account for violations of these Terms.

  1. COMMUNICATION CONSENT
    By providing your contact details, you consent to receive course updates, offers, transactional alerts, and marketing communications via phone, SMS, email, WhatsApp, or other channels from Knowledgespark or its affiliates. You may opt out at any time by contacting support@knowledgespark.in.

  2. COURSE ACCESS AND FEES

  • Access to courses or assessments may require payment of applicable fees as listed on the Platform.

  • Fees are exclusive of taxes, which will be applied as per Indian law.

  • Refund policies, if any, will be specified at the time of purchase.

  • Failure to pay applicable fees may result in suspension of access.

  1. DATA PRIVACY
    Use of the Platform is subject to our Privacy Policy available at https://knowledgespark.in/privacy-policy.

  2. THIRD-PARTY LINKS AND CONTENT
    The Platform may contain links to third-party websites or services. Knowledgespark is not responsible for their terms, content, or privacy practices.

  3. INTELLECTUAL PROPERTY AND COURSE MATERIALS

  • All course content, videos, assessments, and materials provided are the intellectual property of Knowledgespark or its licensors.

  • You may not record, distribute, sell, or share course materials without written permission.

  • Certificates of completion are for personal use only and subject to course requirements.

  1. DISCLAIMERS AND LIMITATION OF LIABILITY

  • The Platform and services are provided “as is” without warranties.

  • We do not guarantee uninterrupted or error-free access.

  • Knowledgespark is not responsible for technical issues, data loss, or damages arising from Platform use.

  • Our total liability is limited to the fees paid by You in the preceding one (1) month for the affected service.

  1. INDEMNIFICATION
    You agree to indemnify Knowledgespark, its affiliates, and employees against claims arising from your use of the Platform, breach of these Terms, or violation of rights of third parties.

  2. TERMINATION

  • Knowledgespark may suspend or terminate your account or access to the Platform for breach of Terms, illegal activity, or as required by law.

  • Upon termination, you must cease using the Platform. Your obligations regarding proprietary rights, indemnity, and limitation of liability shall survive termination.

  1. JURISDICTION AND GOVERNING LAW
    These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Bhubaneswar, Odisha, India.

  2. AMENDMENTS
    We may update these Terms periodically. Changes will be effective upon posting on the Platform. Continued use after changes constitutes acceptance.

These Terms constitute the complete agreement between you and Knowledgespark regarding Platform use.
